General Terms and Conditions

  1. Scope of Application:
    The following General Terms and Conditions, in their version valid at the time of the order, apply exclusively to the business relationship between dein-klettershop.ch and the customer. Dein-Klettershop.ch is a division of Plus-Werk GmbH, and therefore the same General Terms and Conditions also apply to Plus-Werk GmbH and are valid and binding for the customers of Plus-Werk GmbH.
  2. Offers and product descriptions:
    The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. Product descriptions in catalogs and on the seller's websites do not constitute a guarantee or warranty.
  3. Ordering Process and Contract Conclusion:
    The customer can select products from the range without obligation and add them to the shopping cart using the button. By clicking the checkout button or directly to PayPal, the customer submits a binding offer to purchase the goods in the shopping cart. The seller then sends the customer an automatic confirmation of receipt by email. The sale is concluded when prepayment is received; the account details are sent by email.
    When requesting a quote for a climbing wall, the customer fills out the request form, and the «dein-klettershop.ch» team will submit an offer to the customer, which the customer can accept or reject. The sale is concluded after the customer accepts the offer.
  4. Payment Terms:
    The customer can choose from the available payment methods during and before completing the order process. If third-party providers are commissioned to process payments, e.g., PayPal or Payrexx, their terms and conditions apply. All payment methods require payment in advance without deduction. Payment by invoice, e.g., for schools or public institutions, must be arranged with dein-klettershop.ch in advance. 
  5. Retention of title:
    The delivered goods remain the property of the seller until full payment has been received.
  6. Warranty for defects and guarantee:
    The warranty is governed by statutory regulations. A guarantee for the goods supplied by the seller only exists if it has been expressly given.
  7. Delivery and Shipping Costs, Assembly:
    The customer can select delivery and shipping options during the ordering process.
    Shipping via Swiss Post:Shipping costs depend on the total weight and size of the ordered items and are sent via Swiss Post. Delivery of the goods usually takes place within three to six business days after receipt of payment.
    Collection: The customer arranges a collection date with the dein-klettershop.ch team.
    Transport and Assembly by the dein-klettershop.ch Team: When ordering a climbing wall according to the offer, the dein-klettershop.ch team can transport and assemble the climbing wall at the desired installation location. The costs for transport and assembly are calculated based on the distance (km) and the hourly rate of two employees. The minimum cost is CHF 500.
  8. Returns and Exchanges : Customers must notify dein-klettershop.ch of returns , stating 
    the reason for the return, by emailing 
    info@plus-werk.ch . Return postage or shipping costs are the responsibility of the buyer. Goods should be returned in their original packaging with all accessories to Plus-Werk GmbH, dein-klettershop.ch. We accept returns of delivered products and items that do not meet the customer's expectations, but were correctly delivered by us after ordering, within 5 days of receipt. The return must arrive at our premises within this period. For returns of goods valued at CHF 250 or more, we charge a processing fee of 25% of the original purchase price.

    must be reported to the post office within 5 days. The transport risk is borne by the customer in all cases. Incoming goods must be checked immediately for completeness and damage.
  2. Customer's Right of Withdrawal:
    If operational disruptions prevent us from delivering the purchased goods within three weeks of receiving payment, the customer is entitled to withdraw from the contract. For orders for the production of a climbing wall, the contract is binding upon acceptance of the offer and is therefore non-binding.
  3. Data Protection:
    The seller processes the customer's personal data for specific purposes and in accordance with legal regulations. The personal data provided for the purpose of ordering goods (such as name, email address, postal address, and payment details) are used by the seller to fulfill and process the contract. This data is treated confidentially and is not disclosed to third parties who are not involved in the ordering, delivery, and payment process. The customer has the right to request, free of charge, information about the personal data stored about them by the seller. They also have the right to correct inaccurate data, and to block or delete their personal data, provided there is no legal obligation to retain it.
  4. Liability:
    The liability of dein-klettershop.ch and Plus-Werk GmbH, the seller, is limited to intent and gross negligence. The seller is not liable for any impairments resulting from force majeure, misconduct by third parties, revoked permits, or changed fees. The seller assumes no liability for services provided by third parties. Any warranty claims against third parties are assigned to the customer. Liability for the customer's assistants, third parties, or employees is excluded. No liability is assumed for consequential damages. In any case, liability is limited to the value of the contract or the periodically owed amounts. The seller is not liable for consequential damages and/or lost profits. The seller is not liable under any circumstances for claims asserted by third parties or authorities in connection with information provided or content uploaded by the customer, in particular for damages or misconduct caused by the customer, their representatives, or other third parties. The customer is responsible for liability and insurance in such cases.
  5. Jurisdiction, Applicable Law, Subject Matter of the Contract:
    The place of jurisdiction and performance is the seller's registered office. All contracts between the seller dein-klettershop.ch, Plus-Werk GmbH and the customer are subject to Swiss law. The contract language is German.
